The roots of Ostrom's commons work

Continuing the series on "The Tragedy of the Commons at 50" (the last post is here), Fabien Locher's "Historicizing Elinor Ostrom: Urban Politics, International Development and Expertise in the U.S. Context (1970-1990)" provides interesting historical context for the work of Ostrom and the huge body of commons studies she inspired. The abstract:
The goal of this article is to write a social and political history of the now preeminent approach to the ‘commons’ institutions, by focusing on Elinor Ostrom’s contributions to its development. My methodology is that of Science and Technology Studies (STS). I focus here on the materiality of E. Ostrom and her team’s research practices (fieldwork, data collecting, indexing and analysis), on their intellectual and institutional strategies, their networking practices, how their research was funded, and their interactions with administrative and academic institutions and actors (USAID, NSF, National Academy of Sciences). I analyze the history of the Workshop in Political Theory and Policy Analysis, the research center that E. Ostrom and her husband Vincent founded and animated for some 40 years at Indiana University, Bloomington. By doing so, I hope to be able to analyze the close ties between the form and content of the Ostromian theories on the commons and the main lines of tension in the U.S. society of the 1970s and 80s that saw their emergence: urban crisis and “neighborhood revolution”, increasing distrust of modernization and centralization ideals, mutations in U.S. development policies and doctrines, rise of neoliberalism.

Love Canal, CERCLA, and deregulation

This past summer H-Environment published a Roundtable Review of Richard Newman's Love Canal: A Toxic History from Colonial Times to the Present (OUP, 2016). An excerpt from Stephanie Malin's contribution:
While the Superfund Act [CERCLA] resulted from national awareness of Love Canal, and though Newman focuses on the success that legislation represents, we conclude with a troubling denouement. Love Canal is now Black Village Creek, filling up with a new round of working-class residents enticed by homes priced 10 – 20% below market value. Though former residents including Gibbs fought the relocation, they lost this battle. Developers won. The results have been tragic; as Newman recounts, health problems and toxic exposures have reemerged in this ‘remediated’ community, despite the extensive, state-of-­the-­art environmental engineering schemes used to filter leachate and otherwise remediate the site.
Newman’s Love Canal succeeds in highlighting for readers an exceptionally timely notion: before the institutionalization of the U.S. Environmental Protection Agency’s Superfund Program, the American landscape was riddled with unregulated, unmonitored, and often unknown chemical and industrial dumps from America’s dizzying participation in the Industrial Revolution. Communities like Love Canal that dealt with these historical mistakes, Newman shows, contended with rampant pollution, contested and rare health outcomes, and instances of deep disempowerment. Newman showcases for his readers the immense risks and voluminous unintended consequences that emerge when environmental regulations are absent and when the precautionary principle is eschewed in favor of industrial economic development, in one era after another. His historical details, and his careful examination of the numerous barriers faced by Love Canal activists, display that regulatory programs that protect public and environmental health are relatively new, have been hard won, and are constantly vulnerable to eradication. Indeed, these are the very programs that have most swiftly come under attack under the Trump Administration – which makes Newmans’s message so relevant and timely.

Colonial aspects of international environmental law

Douglas de Castro recently posted "The Colonial Aspects of the International Environmental Law – Treaties as Promoters of Continuous Structural Violence". This is a topic that has come up before in work by Yoriko Otomo and others. De Castro's abstract:
The formation of international institutions in the twentieth century occurs under a scenario marked by the rule of colonialism and imperialism. Thus, instead of reducing inequalities in the world system, international institutions reproduce a prevalent logic of material and subjective discrimination based on a colonialist ideology marked by violence, which is communicated in a certain way so that it can justify its importance and legitimacy. The colonial violence is perpetuated under the form of symbolic violence manifested in the language that imposes a universal meaning and systemic violence that manifests itself in the "perfect" functioning of the world economic and political system as the ultimate form of development. One of the perverse and subtle dimensions of this violence is observed in the emergence of the International Environmental Law in terms of metanarratives that excludes minorities and perceptions other than the ones propagated by international institutions. The main objective of this article is identifying the dynamics in the formation of environmental treaties leading to standard results of discursive practices that feeds the process of dependence and legitimation marked by colonial ruling and structural violence. The methodological approach relies on the critical theory tenets to expose the non-emancipatory features of the current International Environmental Law by the application of the socio-legal approach to the treaties that consists of the text analysis (law), subtext (the moral aspects of the law – deep or implicit meanings), and context (the undeniable connection between law and reality). The empirical dimension is developed with the help of the computer assisted qualitative data analysis software (CADQAS) called ATLAS.ti.

Water management and American liberalism

Water Alternatives recently published a review by Joe Williams of JJ Schmidt, Water: Abundance, Scarcity, and Security in the Age of Humanity (NYU Press, 2017). From the review:
The central argument – which might rankle were it not so meticulously made – is that as critical hydro-social scientists we have been getting things wrong for years. Schmidt contends that the old story about the separation of society and nature under modernity and the entrenchment of binary Enlightenment thinking does not apply to water management. The conceptual starting point of many critical scholars, of the transformation of naturally occurring and materially messy 'water', to the industrial product 'H2O', delineated, separate from nature, is, according to Schmidt, a false premise. The logic of water management conceived in the United States in the late 1800s, that has since spread across the world, has instead always connected human society, through water, to the land and geological history in particular and politically significant ways. "The difficulty", he argues, "is not a society/nature dualism or even unique human agency. Rather, the problem is the historical attempt (and ongoing consequences) of a failed strain of social science in the United States that sought to do away with the society/nature dualism" (190). This philosophy of water, through which American (and now global) societies are intimately connected to the land, is given the conceptual handle of 'normal water'. By this, Schmidt refers to the "program of bringing water’s social and evolutionary possibilities into the service of liberal forms of life" (6). Normal water, then, describes a normalised and entrenched set of socio-cultural practices, economic conventions, technological and institutional structures, and geological processes, that link together human society, biological life and planetary evolution under the logic of liberalism. The book traces the development of normal water through its inception at the beginning of American expansionism, its internationalisation under post-war development, and into the Anthropocene.
The political, techno-institutional and conceptual emergence of normal water, according to Schmidt, is premised on three assumptions: "that water was once abundant, that it has now become scarce, and, as an outcome of mismanaging scarcity, that water is now an issue of security" (41). The book is correspondingly structured into four parts. Part one, Abundance, concerns the framing of water as a resource central to the development of American society. It focusses on several key figures associated with the Washington DC-based Cosmos Club around the end of the nineteenth century and beginning of the twentieth, notably W.J. McGee and John Wesley Powell. Water was seen by these men as having geological agency that, if combined with human agency, could form the basis of the most advanced form of liberal society. The driving principle of normal water in the era of abundance, Schmidt says, was that the agency of water could be "synced with the coevolution of American society and the mutual adjustments that water and society made to each other" (79). In an attempt to cement American independence from European colonialism, W.J. McGee even proposed that currency should be tied to water rather than the gold standard. In this respect he was unsuccessful, but the corresponding principle that water was a public good that should be managed for 'the people', Schmidt argues, has formed the bedrock of normal water.

Hurricane Irma, Marco Island, and wetlands protection

Slate recently published a piece by Henry Grabar, "The Lessons of Marco Island", on the Florida island that was savaged by Hurricane Irma last week and the legal history that enabled its development while protecting nearby wetlands. Some highlights:
Forty years ago, the consensus of the state and federal governments was that Marco Island should not have been built at all. The community was the setting for one of the biggest development controversies in the United States and nearly ruined one of Florida’s largest and most celebrated developers. In a region with a notorious building addiction, it became the site of the environmental movement’s greatest victory over the Florida growth machine. Ecological foresight halted millions of dollars in real estate development and all but ended an engineering technique that had turned the South Florida coast from swampland to resort.

When brothers Robert, Elliott, and Frank Mackle discovered Marco in the early 1960s, half of its 10 square miles consisted of mangrove swamps. Home to just a few hundred people and an abandoned clam factory, it was the single largest undeveloped barrier island property in South Florida.

The plan called for 35,000 residential units, which would require displacing 18.2 million cubic yards of ground (more than 150,000 dump trucks’ worth), dredging the land into channels, and using the dredge to create development sites in the swamp. This method is common across South Florida; Cape Coral, a little to the north, is a good example. Still, at the time, Marco Island was the largest “finger-fill” waterfront housing project to ever come before the Army Corps of Engineers, Science reported in 1976.

Regulating Lake Tahoe

Jerry Frank recently reviewed Michael Makley's Saving Lake Tahoe: An Environmental History of a National Treasure (U. Nevada Press, 2014) for H-Environment. Frank writes that at the heart of the book lays the belief that “the lake’s heritage must take precedence over the unrestricted use of private and commercial properties” (p. 1):
The vast majority of the book offers a blow-by-blow account of the various attempts to manage a unique and highly desirable landscape that straddles two states and encompasses a complex bag of economic, legal, and environmental interests. The narrative focuses primarily on the 1969 creation of the first bistate regional agency—the Tahoe Regional Planning Agency (TARPA)—and the “innumerable problems” it has faced in attempting to manage this complex ecological resource (pp. 1, 3).

The task at hand—balancing private property rights against environmental health of both common and shared resources—was exceedingly complex. And, as the author argues, the structure of TARPA has seldom been up to the challenge. Those in favor of economic development, including powerful casino interests, often controlled TARPA and pushed a pro-business agenda. This often pleased many, but not all, of the locals. Many concerned with the environmental health of the lake, including leadership of the Sierra Club and many elected officials from the state of California, were often at odds with further development around the lake and in favor of more stringent environmental protections. The difficulties in getting these interests to coordinate their efforts has led to a seemingly endless string of disputes, some of which have found their way to the Supreme Court.
There is much in Saving Lake Tahoe of value. It is certainly the most detailed look at the complex efforts to share this fragile and valuable resource. That said, there are deficiencies. Books that focus on policy issues must balance the details required to understand the fine points of the policy against providing a compelling narrative. In this instance, the complex history of TARPA combined with the author’s close personal connection to the material often makes it difficult for him to step away from the weeds and offer broader analysis of the proceedings. Had he used a stronger analytical frame he would likely have had more success in this regard. Arthur F. McEvoy’s The Fisherman's Problem: Ecology and Law in the California Fisheries (1986) comes immediately to mind. Lake Tahoe, which is both a private and common resource, presents a history of failed regulation. At the heart of that failure was the inability of a myriad of governing bodies to cooperate in such a way that management of the resource reflected the dynamic nature of the resource itself. Had the author engaged in a more rigorous way the deeper meaning and import of Tahoe’s history by engaging more of the historiography of resource regulation, Saving Lake Tahoe could have had a greater impact. Still, for those interested in the decades-long battles to save this incredible resource, Saving Lake Tahoe will be of value.

Environmental justice in India

Environmental Justice recently published Ravi Rajan's "A History of Environmental Justice in India". The abstract:
Indian environmentalism has, for the most part, been about social justice. During the 1970s and 1980s, it was concerned with differential access to natural assets and ecosystem services. The Bhopal Gas Disaster of 1984 raised new issues, pertaining to industrial risk and safety. This article traces the history of environmental justice from the 1970s onward. It describes the perspective of Indira Gandhi, India's Prime Minister from 1967 to 1984, and her attempts at reconciling the environment with development and economic justice; discusses the emergence of a red-green environmentalism during the 1980s and 90s; and explores Bhopal and its implications; before addressing the issues that are front and center today, in the early twenty-first century.
The article has some trenchant quotes from Indira Gandhi's speech, "Man and Environment", at the United Nations Conference on Human Environment at Stockholm in 1972. Here's one:
The extreme forms in which questions of population or environmental pollution are posed, obscure the total view of political, economic and social situations…It is an over-simplification to blame all the world's problems on increasing population. Countries with but a small fraction of the world population consume the bulk of the world's production of minerals, fossil fuels and so on. Thus we see that when it comes to the depletion of natural resources and environmental pollution, the increase of one inhabitant in an affluent country, at his level of living, is equivalent to an increase of many Asian, Africans or Latin Americans at their current material levels of living…All the “isms” of the modern age—even those which in theory disown the private profit principle—assume that man's cardinal interest is acquisition. The profit motive, individual or collectives, seems to overshadow all else. This overriding concern with self and today is the basic cause of the ecological crisis.
Rajan writes:
Indira Gandhi's Stockholm speech was not just a one-off rhetorical flourish in an international forum. It also came to signify the codification of India's approach to development in the second half of the twentieth century. The essence of this approach was that India would strive to harness its natural resources, and invest in modern technology to raise the quality of economic life of the average person. At the same time, efforts would also be made to conserve the environment and preserve its vital forces. Indira Gandhi recognized that there were many shades of gray, and that this grand strategy was easier to talk about rhetorically than implement in practice. For example, she grappled with the consequences of development upon India's tribal peoples and their cultures, only to reconcile the inevitability of development. Again, despite her vehement critique of Western population control advocates, she ended up presiding over an extremely coercive, government-sponsored, forced sterilization program. She lamented the increasing monocultures that resulted with the pursuit of industrial forestry by the government's own forest department but appeared frustrated that her own government did not heed her concerns. In many speeches she repeated the argument in Stockholm that Western industrialism was not a paradigm for countries like India; and articulated the need for balance and alternatives, including, for example, appropriate technology and renewable energy. Yet, she offered no concrete alternatives or pathways for environmental governance.

North and South and "sustainable development"

Over at "The View from the South", Charles McKelvey recently posted on the history of the idea of sustainable development. An excerpt:

The evolution from development to sustainable development was tied to what Pearce and Warford (1993) [World Without End: Economics, Environment, and Sustainable Development, OUP] have called the second environmental revolution.  The first environmental revolution of the 1960s had seen economic growth and environmental protection as irreconcilable opposites, always in conflict.  But the second revolution of the 1980s did not question the need for growth.  Rather, it sought to define how to grow, or how to develop in a form that is sustainable.
The Cuban scholar and environmental specialist Ramon Pichs (2006) [“Medio Ambiente y Desarrollo, 1964-2004” in Libre Comercio y subdesarrollo, La Habana: Editorial de Ciencias Sociales.] maintains that the turn to sustainable development occurred as a result of the participation of organizations and movements of the Third World in the global process of reflection on environmental issues.  From the point of view of the Third World, the ecological revolution of the 1960s, with its call for conservation and for constraints on economic growth, made sense in the context of the developed societies, characterized by over-production and irrational patterns of consumption.  But limiting growth was not a reasonable approach for the underdeveloped societies, which did not have productive patterns that could provide even basic human needs, as a consequence of the neocolonial situation.  However, the Third World discerned from the outset the importance of the ecological revolution as it developed from the 1960s through the 1980s, given its consciousness of the contaminating effects of the prevailing patterns of production and of the global scope of environmental problems.  Thus, Third World participation in the discussion led to a reformulation of the issue, and sustainable development emerged as a new consensual understanding.
